Please read these terms carefully before booking. By placing an order with Fairgo Logistics you confirm you have read, understood, and agree to be legally bound by all terms below.
1. Agreement to Terms
By accessing or using the services provided by Fairgo Logistics (ABN: 94 279 467 365), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions. These terms govern all point-to-point delivery services facilitated through our platform within the Perth metropolitan area, Western Australia. If you do not agree with any part of these terms, you must not use our services. Fairgo Logistics reserves the right to amend these terms at any time; continued use of the service following any such amendment constitutes acceptance.
2. Eligibility & Age Restriction
You must be at least 18 years of age to book a delivery with Fairgo Logistics. By placing a booking, you warrant that you are 18 or older and legally capable of entering into a binding contract under Australian law.
3. Service Area & Coverage
Fairgo Logistics operates exclusively within the Perth Metropolitan Area, broadly defined as the corridor between Mandurah (south) and Joondalup (north), and extending to the eastern suburbs within the metropolitan boundary as defined by the Western Australian Planning Commission. Bookings where either the pickup or dropoff address falls outside this defined service area may be cancelled, and a full refund will be issued.
We do not guarantee coverage to all addresses within the stated boundary. Remote, gated, or otherwise inaccessible locations may be refused at our discretion, with a full refund provided.
4. Prohibited & Restricted Goods
The safety of our personnel and compliance with Australian law are paramount. By engaging our services, you explicitly warrant that your parcel does not contain any of the following:
- Illegal drugs, narcotics, controlled substances, or associated paraphernalia under the Misuse of Drugs Act 1981 (WA) or any applicable Commonwealth law.
- Firearms, ammunition, explosives, knives, or any items classified as dangerous weapons under the Weapons Act 1999 (WA).
- Flammable, corrosive, radioactive, toxic, or otherwise hazardous materials as classified under the Dangerous Goods Safety Act 2004 (WA).
- Stolen property or goods obtained through, or intended for, any illicit purpose.
- Counterfeit currency, documents, or goods in breach of intellectual property law.
- Any goods whose transport is otherwise prohibited under Australian Commonwealth or Western Australian State law.
Suspicious Goods Policy & Right of Refusal
Fairgo Logistics reserves the absolute and irrevocable right to refuse, halt, or cancel any delivery at our sole discretion if a driver reasonably suspects the contents may violate these terms or any applicable law. In such events:
- The delivery will be immediately terminated without eligibility for a refund.
- Our driver may conduct a visual inspection of external packaging. We do not open sealed parcels without consent or police authority.
- We reserve the right to photograph any suspicious parcel externally as evidence.
- Where unlawful activity is reasonably suspected, the parcel and relevant sender information will be surrendered to the Western Australia Police Force (WAPOL) without prior notice to the sender.
- Fairgo Logistics will cooperate fully with WAPOL and any other law enforcement or regulatory authority investigating a matter connected to our services.

* Items exceeding these limits may be refused at pickup without a refund. Our flat-rate model is designed for parcels, boxes, and handheld items only.
The sender is solely responsible for ensuring items are adequately and securely packaged for transit. Fairgo Logistics accepts no liability for damage resulting from insufficient or improper internal packaging (e.g., lack of bubble wrap for fragile items).
Bulk & Oversize Items: We do not currently move furniture, whitegoods, or unboxed loose items that cannot be safely handled by a single driver. If a driver arrives and determines an item is unsafe to transport or significantly exceeds our 40cm/15kg limits, the booking will be cancelled and the fee forfeited.
In the event of loss or damage caused by proven negligence of Fairgo Logistics, our maximum liability is capped at $50 AUD per delivery. We recommend arranging independent transit insurance for high-value items.
6. Limitation of Liability & Indemnification
Fairgo Logistics operates strictly as a facilitator of local transport. To the maximum extent permitted by applicable Australian law, our liability is limited as follows:
- Indemnification for Illegal Content: The sender assumes full, unconditional legal responsibility for the contents of the parcel. You agree to indemnify and hold harmless Fairgo Logistics, its owners, employees, contractors, and drivers from any claims, damages, fines, penalties, or legal actions arising from the transport of goods later found to be unlawful, where Fairgo Logistics acted without prior knowledge of the illicit contents.
- Consequential Loss: Fairgo Logistics shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, loss of business opportunity, or financial loss resulting from delivery delays, cancellations, or failed delivery attempts.
- Australian Consumer Law: Nothing in these terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Where our liability cannot be excluded, it is limited to the re-supply of the service or payment of the cost of re-supply, at our discretion.
7. Service Fulfillment, Failed Deliveries & Refunds
Bookings made before 3:00 PM AWST are guaranteed for same-day evening dispatch. Bookings made after 3:00 PM AWST are guaranteed for evening dispatch on the following calendar day. "Evening delivery" is defined as a completed dropoff attempt made before 10:00 PM AWST on the scheduled day of dispatch.
If a delivery attempt is made and the recipient is not present or accessible, the driver will make one (1) reasonable attempt to contact the phone number provided at booking. If no contact can be established within ten (10) minutes, the parcel will be retained and the delivery marked as a failed attempt. In this case, no refund is payable, and re-delivery arrangements will be at the sender's cost.
Authority to Leave: By placing a booking, the sender authorises Fairgo Logistics to leave the parcel unattended at the front door, front porch, or other reasonably apparent front-of-house location at the delivery address if the recipient is unavailable at the time of delivery, unless the sender has provided written instructions to the contrary before dispatch. Once the parcel has been left at that location and delivery confirmation has been recorded, responsibility and risk in the parcel passes to the sender and/or recipient, and Fairgo Logistics is not liable for any loss, theft, weather exposure, or damage arising after dropoff, except to the extent liability cannot be excluded under Australian law.
If Fairgo Logistics fails to make a delivery attempt before 10:00 PM AWST on the scheduled day of dispatch due solely to our own operational failure, the customer is entitled to a full refund of the delivery fee. Refund requests must be submitted to sales@fairgo.online within 48 hours of the missed delivery window.
Refunds will not be issued where delays or failed deliveries arise from: incorrect address details; inaccessible or gated properties; recipient unavailability; or any event beyond our reasonable control including but not limited to severe weather, road closures, or civil disruption.
Customer Cancellation: A booking cancelled by the customer after payment is processed is non-refundable once the driver has been dispatched to the pickup location. Cancellations made more than 30 minutes prior to the driver's estimated pickup arrival may be eligible for a refund at our discretion. Contact sales@fairgo.online immediately to request a cancellation.
8. Pricing, GST & Payment
The current delivery fee is $19.90 AUD per booking (the "Introductory Rate"). This is a flat rate applicable to all eligible deliveries within the Perth Metro service area, regardless of distance or time of day. All prices displayed are inclusive of GST as required under the A New Tax System (Goods and Services Tax) Act 1999 (Cth). A GST-compliant tax invoice is available upon request by contacting sales@fairgo.online.
Fairgo Logistics reserves the right to alter its pricing at any time. Any change in pricing will not affect bookings already paid for and confirmed. Payment is processed securely via Stripe. We do not store your card details. All payment processing is subject to Stripe's own terms of service and privacy policy.
9. Privacy & Data Collection
Fairgo Logistics collects personal information — including your name, phone number, pickup address, and dropoff address — solely for the purpose of fulfilling your delivery booking. We handle all personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Your information will not be sold, rented, or shared with third parties except: (a) with our drivers to the extent necessary to complete your delivery; (b) with our payment processor Stripe for transaction processing; (c) with law enforcement authorities where required by law or in accordance with our Suspicious Goods Policy outlined in Section 4.
You may request access to, or correction of, your personal information by contacting sales@fairgo.online. We retain booking records for a period of 7 years in compliance with Australian taxation and business record-keeping obligations.
10. Dispute Resolution & Governing Law
In the event of a dispute arising from or relating to these Terms and Conditions or any delivery service provided by Fairgo Logistics, the parties agree to first attempt resolution through good-faith negotiation. Disputes should be raised in writing to sales@fairgo.online. We will acknowledge all written disputes within 5 business days and endeavour to reach a resolution within 14 business days.
If a dispute cannot be resolved through direct negotiation, either party may refer the matter to the Consumer Protection Division of the WA Department of Mines, Industry Regulation and Safety, or to a mutually agreed mediator, before pursuing formal legal action.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Western Australia and the applicable laws of the Commonwealth of Australia. Both parties submit to the exclusive jurisdiction of the courts of Western Australia.
11. Intellectual Property & Copyright
All content, visual interfaces, interactive features, information, graphics, design, compilation, computer code, software, user interfaces (UI), user experience (UX) flows, and all other elements of the Fairgo Logistics platform (collectively, the "Materials") are heavily protected by Australian and international copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights.
The Fairgo Logistics brand, logo, and platform design are the exclusive property of Fairgo Logistics (ABN: 94 279 467 365).
You are strictly prohibited from:
- Copying, duplicating, cloning, or reverse-engineering the website's source code, design, or layout.
- Scraping, framing, or using automated tools to extract our proprietary data or pricing models.
- Reproducing our branding, logos, or written copy for commercial use, derivative works, or competitive platforms.
Notice of Legal Action
Fairgo Logistics actively monitors the web for copyright infringement and unauthorized cloning. Any unauthorized reproduction, distribution, or commercial exploitation of our intellectual property will be met with immediate legal action. This includes, but is not limited to, issuing formal cease and desist notices, submitting DMCA takedown requests to web hosts, seeking injunctive relief, and pursuing maximum financial damages and legal costs under the Copyright Act 1968 (Cth) and applicable intellectual property laws.
12. General Provisions
- Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable, it shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.
- Entire Agreement: These Terms constitute the entire agreement between the sender and Fairgo Logistics with respect to the subject matter herein and supersede all prior communications or agreements.
- Waiver: Failure by Fairgo Logistics to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
- No Assignment: You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent.
